What is Niet Ontvankelijke Verklaard (NO) Decision

The niet ontvankelijke verklaard decision or commonly referred to as the NO decision is a decision stating that a lawsuit cannot be accepted because it contains a defect (legal), in this case, the court does not resolve the subject matter of the case because the lawsuit filed contains formal defects, which results in the court not being able to determine the Subject matter. This is based on the Indonesian Supreme Court Decision No. 1149/K/Sip/1975 dated 17 April 1975 jo. The decision of the Supreme Court of the Republic of Indonesia No. 565/K/Sip/1973 dated 21 August 1973, jo. Decision of the Supreme Court of the Republic of Indonesia No. 1149/K/Sip/1979 dated 7 April 1979.


Various kinds of formal defects attached to the lawsuit, among others:

  1. Lawsuit signed by a power of attorney based on a power of attorney that does not meet the requirements outlined in Article 123 paragraph (1) HIR;

  2. A lawsuit that has no legal basis;

  3. Lawsuit for error in persona in the form of disqualification or plurium litis consortium;

  4. The lawsuit contains defects osbcuur libel, ne bis in idem, or violates absolute or relative jurisdiction (competence).

Legal efforts that can be made in the decision NO

There are two rights for litigants whose case is declared unacceptable (niet ontvankelijke verklaard) by the court of first instance: 1) to resubmit with a new lawsuit, and 2) to pursue an appeal. When the judge decides that the decision is not accepted at any level, the case can be sued again with the same case. However, if the appeal decision has entered the case material, it has become a final decision and cannot be filed for a new lawsuit with the same material.


Suppose there is an attempt to file a lawsuit with the same lawsuit and party. In that case, this can happen because Article 10 paragraph (1) of Law no. 48 of 2009 concerning Judicial Power states that the Court is prohibited from rejecting cases submitted to it.


Example of the decision no

One example of a NO decision is decision number 11/Pdt.G/2019/PN Kds. The content of the decision is that the judge grants the defendant's exception, in which the Defendant submits an exception stating that the plaintiff's claim is not following the law, the plaintiff's claim is obscure or (obscuur Libel) and also the plaintiff's claim exceptio Non Adimpleti Contractus, namely the exception can be applied in a lawsuit originating from the Mutual treaty, each party is burdened with the obligation to fulfil the Mutual achievements treaty.
